What applies to gastronomy in Spain?
In Spain, there is currently no direct legal requirement for reusable packaging for the catering industry, as has been the case in Germany, for example, since January 1, 2023. However, Spain has introduced extensive measures to reduce single-use plastics and promote reusable packaging, which also affect the catering industry.
🇪🇸 Legal regulations in Spain
On January 1, 2023, Spanish Law 7/2022 on Waste and Contaminated Soil for a Circular Economy came into force. This law includes, among other things:

Single-use plastic tax: A tax of €0.45 per kilogram of non-recycled plastic on single-use packaging, affecting manufacturers, importers, and distributors.

Ban on certain single-use plastic products: Single-use items such as plates, cutlery, cups, and straws made of plastic may no longer be sold or used

Promotion of reusable packaging: Retailers with a sales area of over 300 m² are obliged to offer reusable packaging.

Free tap water: Restaurants must offer their guests free tap water to reduce the consumption of single-use plastic bottles.
🏝️ Special regulations in the Balearic Islands
In the Balearic Islands, including Mallorca, even stricter regulations have been in force since March 20, 2021:

Ban on single-use plastic: The sale and use of single-use plastic products such as dishes, cutlery and straws are prohibited.

Obligation to use compostable materials: Only products made from compostable materials that meet certain certifications are permitted.
