1. General

1.1. The General Terms and Conditions of Austria Creativa 360 SL (hereinafter "VistaCup") apply to all contracts, offers, deliveries, and services resulting from customer orders via the VistaCup online shop www.vistacup.com (hereinafter "Online Shop"), and apply to consumers (hereinafter "Customers") according to the Spanish Civil Code.

1.2. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their commercial or independent professional activity.

1.3. The contract language is Spanish.

1.4. The General Terms and Conditions of VistaCup take precedence; changes are only allowed with the explicit written consent of VistaCup.

2. Conclusion of Contract with or without Printing Order

2.1. The offers in the online shop are non-binding and do not constitute an obligation.
The customer can select the desired products by clicking the "Add to Cart" button. A minimum order quantity, which varies by product, is indicated accordingly.
The quantity of products can be adjusted or individual items deleted in the cart.

2.2. For orders without a printing order, the following applies:
The offers in the online shop are merely an invitation to submit an offer. By clicking "Order with obligation to pay," a binding offer is sent to VistaCup, with prior agreement to the current Terms and Conditions and privacy policy.
VistaCup will immediately send a confirmation email, which constitutes acceptance of the offer. The contract is considered concluded.

2.3. For orders with a printing order, the following applies:
2.3.1. In the "Printing" section of the online shop, there is the option to upload image files and specify printing requests or consultation inquiries.
After submitting the printing request, the customer receives an email confirming the receipt of the inquiry.
VistaCup will then create an offer, provided the required information is provided by the customer, including reproduction costs of the order. These costs are based on the difficulty and effort involved and are listed in the offer. The customer can accept this offer by confirming in writing (email), which concludes the contract.
VistaCup's offer can be accepted within 14 days of receipt. Acceptance after this period is considered a new offer, which VistaCup may accept, and the contract is concluded.

2.3.2. After completion of the online draft, it will be sent to the customer.
The printing of the ordered products only proceeds after written confirmation by the customer (print approval) and full payment received on VistaCup's account, unless otherwise agreed between VistaCup and the customer.

3. Prices, Payment Terms

3.1. The prices in the online shop include packaging costs and statutory VAT.
Delivery and shipping costs depend on the order and are displayed during the checkout process after entering customer details. For printing orders, the delivery and shipping costs are clearly displayed in the written offer.
The shipping and delivery costs are always communicated separately to the buyer in writing.

3.2. Various payment methods are available for the customer, which can be selected during the ordering process. An overview of the available payment methods is provided here.

4. Retention of Title

4.1. The goods remain the property of VistaCup until full payment is made.
4.2. During the period of retention of title, the customer is prohibited from selling or otherwise disposing of the goods.

5. Responsibility for Content, Indemnification

5.1. The customer is solely responsible for all advertising content they create and provide, such as motives, texts, graphics, or images; VistaCup does not adopt this content as its own and assumes that the customer holds all necessary copyright, trademark, or other rights.
VistaCup assumes that necessary official approvals have been obtained for religious groups, political parties, or politically motivated organizations.

6. Delivery Dates, Delivery Periods

The delivery will be made within the stated delivery time for the respective product.
Delivery dates or deadlines are generally non-binding unless explicitly agreed upon by the customer and VistaCup.

7. Printing Specifications, Usage Rights

7.1. For printing orders, the file formats and print data must be submitted in the formats specified by VistaCup ("AI" or "EPS"); if conversion to one of these formats is desired, the costs for this conversion will be listed as reproduction costs in the offer (see 2.2 of these Terms and Conditions).

7.2. A check of the data according to the customer's printing specifications is included in the price for printing; if the customer wishes to send additional modified data, a surcharge of €20.00 plus VAT will be charged for each additional modification.

8. Defects, Warranty Rights

8.1. For material defects, the statutory provisions apply in principle.
8.2. All defect claims expire two years after delivery of the goods.

9. Color Variations, Minor Deviations

9.1. VistaCup makes all reasonable efforts to accurately display product characteristics in the online shop. However, color reproduction depends on the customer's screen system, and a guarantee for color accuracy cannot be given.
9.2. Minor deviations in color for different orders or individual items are not subject to complaints. This applies particularly to minor color deviations between multiple orders, previous orders, or mass printing.

11. Assignment

VistaCup reserves the right to assign or pledge all payment claims related to the delivery of goods, including all installments, to third parties.

11. Participation in Dispute Resolution Procedures

VistaCup is obligated to participate in a dispute resolution procedure.

12. Data Protection

12.1. VistaCup collects and stores the necessary personal data of the customer for business processing, in accordance with applicable data protection laws; further details are outlined in the privacy policy available in the online shop.

12.2. Upon request, the customer can obtain information about the data stored concerning them.

13. Applicable Law, Malaga, Spain

Registered in the Málaga Commercial Register

13.1. The contract between VistaCup and the customer is subject to Spanish law, excluding the UN Sales Convention (CISG).

13.2. If any provision of these Terms and Conditions or any provision in other agreements is invalid or becomes invalid, the validity of all other provisions or agreements remains unaffected.
